A four-dimensional operator is shown to contain the operator-generators for rotation, scale, reflections, and boosts. The hypothesis is advanced that a physical system changes under this operator by at most a complex phase factor due to invariance against the choice of menial frame. A canonical transform gives a simple relation between space-time and energy-momentum. The basic conserved quantity is a four-dimensional angular momentum and/or coupling constant. The differential of this function contains a second-order differential product which is constrained as a (...) power series in the independent variable. We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...) released from her current confinement and transferred to an appropriate elephant sanctuary, pursuant to habeas corpus. In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

Abstract:Human and animal research both operate within established standards. In the United States, criticism of the human research environment and recorded abuses of human research subjects served as the impetus for the establishment of the National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research, and the resulting Belmont Report. The Belmont Report established key ethical principles to which human research should adhere: respect for autonomy, obligations to beneficence and justice, and special protections for vulnerable individuals and (...) populations. While current guidelines appropriately aim to protect the individual interests of human participants in research, no similar, comprehensive, and principled effort has addressed the use of (nonhuman) animals in research. Although published policies regarding animal research provide relevant regulatory guidance, the lack of a fundamental effort to explore the ethical issues and principles that should guide decisions about the potential use of animals in research has led to unclear and disparate policies. Here, we explore how the ethical principles outlined in the Belmont Report could be applied consistently to animals. We describe how concepts such as respect for autonomy and obligations to beneficence and justice could be applied to animals, as well as how animals are entitled to special protections as a result of their vulnerability. ABSTRACT:Despite widespread attention to corruption and organizational change in the literature, to our knowledge, no research has attempted to understand the linkages between these two powerful organizational phenomena. Accordingly, we draw on major theories in ethics, sociology, and management to develop a theoretical framework for understanding how organizational change can sometimes generate corruption. We extend anomie theory and ethical climate theory to articulate the deinstitutionalization of the normative control system and argue that, through this deinstitutionalization, organizations have the potential to (...) become incubators for corruption. We qualify this process by proposing conditions more ripe for anomie and under which this deinstitutionalization is more likely to occur, propounding moderating relationships that influence organizational reconfiguration. Examples of turbulence in the contemporary business environment that can trigger change highlight our discussion. We conclude with managerial implications, offering means by which the deleterious effects of corruption may be arrested or controlled. (shrink)

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

As it stands, the divide between religion and politics within Rawlsian political liberalism inadequately attends to the role of moral beliefs, especially those used to justify and reinforce antiblack racism, in forming and fashioning political commitments. By introducing tragic soul-life and Du Bois's category of second sight, I plan to show how a (...) reflective model of deliberation based on Du Boisian themes will allow social actors to interrogate the overlap between political and comprehensive beliefs without necessarily compromising democratic traditions on which rest political conceptions of justice. This essay explores the degree to which public reason can sustain political liberalism's commitment to justice and pluralism without attending to the role of what Jeffrey Stout calls “cultural inheritance” in shaping and justifying political commitments. At issue is whether public reason is the best resource for guiding conversations on political matters that are enmeshed in religious commitments and moral beliefs. Unless public reason can account for cultural inheritance, and foster a deliberative context in which political actors might grapple with (...) the relationship between overlapping political claims and comprehensive doctrines, public reason will remain narrow and inadequate in a contemporary world where epistemic diversity is increasingly at odds with political liberalism's normative model of social cooperation and public deliberation. We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. David Johnson seeks to overthrow one of the widely accepted tenets of Anglo-American philosophy—that of the success of the Humean case against the rational credibility of reports of miracles. In a manner unattempted in any other single work, he meticulously examines all the main variants of Humean reasoning on the topic of miracles: Hume's own argument and its reconstructions by John Stuart Mill, J. L. Mackie, Antony Flew, Jordan Howard Sobel, and others. Hume's view, set forth in his (...) essay "Of Miracles," has been widely thought to be correct. Johnson reviews Hume's thesis with clarity and elegance and considers the arguments of some of the most prominent defenders of Hume's case against miracles. According to Johnson, the Humean argument on this topic is entirely without merit, its purported cogency being simply a philosophical myth. (shrink)

The rule of law is a necessary condition for any substantive theory of justice. If a theory sacrifices the rule of law, justice, too, is sacrificed. The connection between the necessary condition and justice is explored in the work of John Rawls, H. L. A. Hart, Karl Marx, Emile Durkheim, Albert Camus and William Shakespeare. The conceptions of justice elaborated in each of these political thinker's works share very little more than the rule of law. Since the conceptions examined (...) are so different and the necessary condition is contained in each, I conclude that there is substantial support for the thesis. ;In order to do justice to the texts examined in this dissertation the plain language, the words on the page, must be given priority but cannot be fully determinative of the text's meaning. The immanent structure of the text, the rules of the text which give it shape and form, must also be discerned. There are no particular rules for interpretation in general, yet each text contains within it its own individual rules. The rules of the text are what allow the meanings of the text to play themselves out for different readers. Understanding the history of the text is also important for interpretation. ;Some interpretations of the theories of justice examined here have sought to change the substance of that theory through interpretation. For example, Marx's theory depends upon the law of equal commodity exchange. As shown in chapter three, if an alien supposition of distributive justice is interpreted into Marx's theory so that the surplus value which Marx claims belongs to the capitalist is redistributed, then the proposed transition to communism, which Marx analyzed and supported, will not occur. Doing justice to Marx's texts allows Marx's theory of justice to come through and be judged on its own terms. Only after that has been accomplished can it be evaluated and compared with other theories. The same association between interpretative method and substantive meaning is demonstrated for each theory. The conclusion compares interpretation in law and drama and connects doing justice to texts with justice. (shrink)

This roughly 80 page pamphlet introduces syllogistic vocabulary (...) and reasoning so that syllogisms can be created from Biblical texts. The use of logic for proselytizing purposes is not distinctive: What is distinctive about Eliot's book is that it is bilingual, written in both English and Massachusett (Wôpanâak), an Algonquian language spoken in eastern coastal and southeastern Massachusetts. It is one of the earliest bilingual logic textbooks and it is the first, and perhaps only, textbook in an indigenous American language.In this paper, we (1) introduce John Eliot and the linguistic context he was working in; (2) introduce the contents of the Logick Primer – vocabulary, inference patterns, and applications; (3) discuss notions of ‘Puritan’ logic that inform this primer; and (4) address the importance of his work in documenting and expanding the Massachusett language and the problems that accompany his colonial approach to this work. Obvious typographical errors have been carefully corrected and the entire text has been reset and redesigned by Pen House Editions to enhance readability, while respecting the original edition."A Problem in Greek Ethics" is an account of (...) sexuality between men in all its forms, with Greek culture as a backdrop. Perhaps the best description of "A Problem in Greek Ethics" is this one in "Queer Religion" (Praeger, 2012, edited by Donald L. Boisvert and Jay Emerson Johnson, pp. 180-181): "Published at the turn of the century, 'A Problem in Greek Ethics' is a systematic and well-documented exposition of the role of homosexuality in the different historical periods of ancient Greek society. Throughout most of his work, Symonds prefers to use the term 'paiderastia' to 'homosexuality,' the latter a term he only uses in rare instances. Nevertheless, 'paiderastia,' in Symonds's work, amounts to a broad concept of homosexuality rather than to our current concept of pederasty. Whitman and his work are never mentioned by Symonds in 'A Problem in Greek Ethics,' but the conceptual connection had already been made explicit in Walt Whitman: 'A Study' eight years earlier. In the introductory lines to 'A Problem in Greek Ethics,' the reader is alerted that ancient Greece offers a unique example in history of 'a great and highly developed race not only tolerating homosexual passions, but deeming them of spiritual value, and attempting to use them for the benefit of society.' According to Symonds, while homosexual relations were not prominent in the so-called heroic age of Greece, it was nevertheless the love of Achilles for Patroclus, as narrated by Homer, that conferred in a later age of Greek history an almost religious sanction to the martial form of paiderastia. This episode in the Iliad inspired in later generations an ideal of manly love, which he describes as 'a powerful and masculine emotion, in which effeminacy had no part, and which by no means excluded the ordinary sexual feelings.' To which he adds that the tie created by these relationships was 'both more spiritual and more energetic [than] that which bound man to woman.' While Homer knew not about homosexuality, very early in Greek history paiderastia became a national institution giving rise, according to Symonds, to a distinction between a noble, spiritual, form of masculine passion, which he calls "heroic love," and a base and sensual one, which he identifies as 'vulgar love.'"About the Author: John Addington Symonds was born in Bristol, England, in 1840. He was an English poet, an author of several works, and a literary critic. In 1873 he wrote "A Problem in Greek Ethics," which discussed homosexuality between men. He printed ten copies in 1883, before effectively publishing the book in 1901. He was also known for his work on the Renaissance, as well as for his translations and biographies. He wrote "Our Life in the Swiss Highlands" (1891), biographies of Philip Sidney (1886), Ben Jonson (1886) and Michelangelo (1893), several volumes of poetry and essays, and a translation of the "Autobiography of Benvenuto Cellini" (1887). John Addington Symonds died in Rome in 1893. In 1896, Havelock Ellis published, in German, prepared with the collaboration of Dr. Hans Kurella, "Das konträre Geschlechtsgefühl" (Leipzig, by Georg H. Wigand's Verlag), later revised and published by Ellis as "Sexual Inversion"-the first medical text in English about homosexuality, which he had co-authored with Symonds, and which would become a part of Ellis's six-volume "Studies in the Psychology of Sex.". Revealing Male Bodies is the first scholarly collection to directly confront male lived experience. There has been an explosion of work in men's studies, masculinity issues, and male sexuality, in addition to a growing literature exploring female embodiment. Missing from the current literature, however, is a sustained analysis of the phenomenology of male-gendered bodies. Probability is sometimes regarded as a universal panacea for epistemology. It has been supposed that the rationality of belief is almost entirely a matter of probabilities. Unfortunately, those philosophers who have thought about this most extensively have tended to be probability theorists first, and epistemologists only secondarily. In my estimation, this has tended to make them insensitive to the complexities exhibited by epistemic justification. In this paper I propose to turn the tables. I begin by laying out some rather simple (...) and uncontroversial features of the structure of epistemic justification, and then go on to ask what we can conclude about the connection between epistemology and probability in the light of those features. My conclusion is that probability plays no central role in epistemology. This is not to say that probability plays no role at all. In the course of the investigation, I defend a pair of probabilistic acceptance rules which enable us, under some circumstances, to arrive at justified belief on the basis of high probability. But these rules are of quite limited scope. The effect of there being such rules is merely that probability provides one source for justified belief, on a par with perception, memory, etc. There is no way probability can provide a universal cure for all our epistemological ills. Hermann Weyl, one of the twentieth century's greatest mathematicians, was unusual in possessing acute literary and philosophical sensibilities—sensibilities to which he gave full expression in his writings. In this paper I use quotations from these writings to provide a sketch of Weyl's philosophical orientation, following which I attempt to elucidate his views on the mathematical continuum, bringing out the central role he assigned to intuition.

This new edition of the classic Contemporary Theories of Knowledge has been significantly updated to include analyses of the recent literature in epistemology.

This Element is an exposition of second- and higher-order logic and type theory. It begins with a presentation of the syntax and semantics of classical second-order logic, pointing up the contrasts with first-order logic. This leads to a discussion of higher-order logic based on the concept of a type. The second Section contains an account of the origins and nature of type theory, and its relationship to set theory. Section 3 introduces Local Set Theory, an important form of type theory (...) based on intuitionistic logic. In Section 4 number of contemporary forms of type theory are described, all of which are based on the so-called 'doctrine of propositions as types'. We conclude with an Appendix in which the semantics for Local Set Theory - based on category theory - is outlined. (shrink)
